Effective 28 August 2026. This policy applies to [LEGAL ENTITY NAME], trading as Owed ("Owed", "we", "us"), and to this website and the services described on it.

Before launch: this policy is written to be accurate to how the service actually works, but it has not been reviewed by a lawyer. The bracketed items below need real values, and counsel should read it before any traffic is bought.

1. Who we are and what we do

Owed helps people and entities recover surplus funds held by a county or a state after a foreclosure or tax sale. Owed is not a law firm, does not provide legal advice, and is not a government agency or affiliated with one.

2. Information we collect

Category	What it includes
You give us	Name, phone number, email address, the property address, the county, when the sale happened, your relationship to the property, and your answers to the questions in our check.
Consent record	Whether you ticked the consent box, and the date, time and IP address when you did. We keep this because we have to be able to show that contacting you was permitted.
Automatically	IP address, browser and device information, pages viewed, and advertising identifiers such as a Google Click Identifier (gclid) and UTM parameters, so we can tell which ad brought you here.
Public records	Information published by counties, courts and states about foreclosure and tax sales, including names, property addresses, sale dates and surplus amounts. See section 3.

3. Public records, and people who never contacted us

Surplus funds are a matter of public record. We maintain a database built from records published by counties, courts and states, and it therefore contains information about people who have never contacted us. We use it for one purpose: to determine whether a person who asks us to check may have a claim.

We keep those records even after the original source stops publishing them. A record disappearing from a public list does not mean the money was claimed, and a person whose foreclosure was years ago may still be owed. If you are in that database and want your information removed, see section 8. We will honour that request whether or not you have ever been a customer.

4. How we use information

To check whether a county or state appears to hold surplus funds connected to your name.
To contact you about that check, by phone, text or email, where you have consented.
To prepare and file a claim, if you engage us to do so.
To measure which advertising works, and to improve the service.
To meet legal, tax and record-keeping obligations.

5. Calls, texts and emails

If you tick the consent box, you agree that Owed and its recovery and attorney partners may contact you at the number you gave us, including by autodialer, prerecorded message and text, even if that number is on a Do Not Call list. Consent is not a condition of service, and you can ask us to check for you without agreeing to automated contact. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. You can unsubscribe from email using the link in any message.

6. Who we share information with

We do not sell your personal information. We share it only with:

Recovery and attorney partners working on your claim.
Service providers who run things on our behalf, such as our CRM, hosting, phone and email providers, and analytics. They may use it only to provide that service to us.
Counties, courts and state agencies, where that is necessary to file or support your claim.
Authorities, where the law requires it, or to protect our rights or someone's safety.

We use Google Analytics and Google Ads. Those services set their own identifiers and are governed by Google's own privacy terms.

7. Do Not Sell or Share My Personal Information

Owed does not sell personal information, and does not share it for cross-context behavioural advertising, as those terms are defined under California law. We do use advertising and analytics cookies, which some laws treat as "sharing". To opt out of that use, email [PRIVACY EMAIL] with the subject line Do Not Sell or Share, or use your browser's Global Privacy Control signal, which we honour where required.

8. Your rights and how to use them

Depending on where you live, you may have the right to know what we hold about you, to get a copy, to correct it, to delete it, to opt out of sale or sharing, and not to be treated differently for exercising any of these. To make a request, email [PRIVACY EMAIL] or write to [POSTAL ADDRESS]. We will verify your identity before we act, and we will respond within the time the law allows.

9. How long we keep things

We keep claim records for as long as needed to provide the service and to meet legal and tax obligations. We keep the public-records database on an ongoing basis for the reason given in section 3. We keep consent records for at least the period required to demonstrate compliance with telephone-consumer-protection rules. When we no longer need information, we delete it or anonymise it.

10. Security

We use encryption in transit, access controls, and vendors who do the same. No system is perfectly secure, and we do not promise that ours is.

11. Children

This service is not directed to anyone under 18 and we do not knowingly collect their information.

12. Changes

If we change this policy we will post the new version here and update the effective date.
